General Provisions

  1. By navigating this site, the user accesses CMAX through the URL: www.cmaxitaly.com. Browsing and sending a request for a graphic preview or placing an order implies acceptance of the Terms and Conditions and Privacy Policy adopted by the site.

  2. These General Terms and Conditions of Sale apply to the sale of goods and the provision of services exclusively for purchases made on the site in accordance with Part III, Title III, Chapter I, of the Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree No. 70/03) by:

  1. Before accessing the products and services provided through the site, the user is required to read these Terms and Conditions of Sale, which are generally and unequivocally accepted at the time of purchase.

  2. The user is invited to download and print a copy of the order form and these General Terms and Conditions, which are subject to unilateral modification without notice.

Purpose

  1. These General Terms and Conditions of Sale govern the offer, dispatch, and acceptance of purchase orders for goods and services and do not regulate the provision or sale of products/services by parties other than the seller that are present on the same site via links, banners, or other hypertext connections.

  2. Before placing orders and purchasing products/services from third parties, it is advisable to check their sales conditions.

Image Rights By submitting images, the customer declares to own them and/or have the right to use them.

LEZDOIT S.R.L.S. reserves the right to refuse to execute vulgar and/or inappropriate customisations.

In the case of trademark use, the Customer declares to have been authorised by the legitimate owner, assuming all responsibility and expressly relieving CMAX from any third-party claims.

Graphic previews are a free service provided by LEZDOIT for illustrative purposes only. Therefore, they remain the exclusive property of LEZDOIT.

Under no circumstances is it possible to receive files without the CMAX watermark, whether source (vector) files or image formats.

Should the customer or a third party come into possession of such files, any use other than for illustrative purposes for the creation and printing of clothing material is not permitted.

LEZDOIT S.R.L.S. reserves the right to use the graphics for promotional, illustrative, and advertising purposes, removing graphic elements related to the customer that may be subject to usage restrictions (logos, sponsors, trademarks, etc.)

Graphic Design and Production

The service offered by LEZDOIT includes graphic design and production processes.

To avoid any errors or disputes, please pay attention to the following information:

CHECK: The final verification of the order confirmation document is the responsibility of the customer. Special attention must be paid to the product design, chosen models, colours, logos, numbering, names, and sizes.

For the final result on fabric, always consider the 2D print layout (if sent) and never the 3D graphic model.

The 3D model is only an example of the fit of our garments and is created with effects, lights, and shadows that are sometimes different because they are customised according to the creative style of the designer dedicated to the project.

WARNING! The size deviation after tailoring, compared to the measurements reported in the size chart, may vary from 1 to 3 centimetres.

PREVIEW: The preview images are considered illustrative. During printing, the proportions of graphic elements may undergo slight variations to adapt to the model and sizes of the garments.

Our free graphic preview service requires a lot of time and resources. It should not be taken lightly as it is aimed at purchase and limited to one preview per team (for example, if a sports club has 20 players and 2 teams or has specified that it needs kits for home and away matches, it can get two previews).

Therefore, it is recommended to request the preview with the clearest possible ideas in mind, referring to our extensive model catalogue attached or another model of your choice.

To receive multiple previews, a deposit is required, the amount of which varies according to the needs and will be deducted from the total invoice amount.

This deposit can be deducted from the total amount within a maximum of 6 months from the delivery of the 3D graphic.

PRINTING: The sublimation process is subject to thermal, climatic, and environmental conditions.

It is not possible to guarantee the exact reproduction of colour tones compared to digital previews; please allow a tolerance of approximately 15%. Also, in the case of restocking, the exact reproduction of colours compared to previous productions cannot be guaranteed.

RESTOCKING: Restocking can only be done based on the previously accepted graphic model. There is no minimum quantity to respect; restocking can be done even for a single item (small additional costs apply for fewer than 10 items to be restocked). The timelines are to be verified based on the production queue.

COMPLEMENTARY PRODUCTS: Some complementary commercial products added to the order (such as socks) are not produced by us and may have slightly different colour tones from ours. By confirming the order, you have read and understood the above conditions. Following the acceptance and approval of the graphics, LEZDOIT will not be responsible for errors resulting from the above conditions.

Contract Conclusion

  1. To start a purchase contract, it is necessary to complete the electronic form (Form) and send it with the related instructions.

  2. The site www.cmaxitaly.com contains the General Terms and Conditions of Sale, information on each service purchased, the payment methods that can be used, the delivery methods of the purchased products, and related shipping information. The seller is not responsible for the inadequacy of the representations of the products presented. The representations are for illustrative purposes only.

  3. Before concluding the contract, the user will be asked to confirm that they have read the General Terms and Conditions of Sale, including the information on personal data processing.

  4. The contract is concluded when the seller receives the form duly completed by the user, after verifying the correctness of the data contained therein.

  5. The buyer will be required to pay the price at the end of the order data transmission procedure. This will occur by proceeding with the total payment through one of the available payment methods.

  6. Once payment is received, the seller will proceed with the production and shipment of the order.

Product Availability

  1. Product availability refers to the availability at the time the buyer places the order. This availability must in any case be purely indicative as, due to the presence of multiple users on the site, products may be sold to other customers before the final order confirmation.

  2. Even after sending the e-mail confirmation of the order and payment, partial or total unavailability of the goods may occur (e.g., due to lack of raw materials). In this case, the order may be automatically corrected by removing the unavailable product, and the buyer will be informed by e-mail.

  3. If the buyer requests the cancellation of the order resolving the contract, LEZDOIT, before any possible refund within 15 days from when it becomes aware of the withdrawal decision, reserves the right to verify the progress of the production phase for the order in question. If the order has already been partially or totally produced, the withdrawal request will be considered null.

Payment Methods and Prices

  1. The price of products and services will be visible during the completion of the Create Kit Form.

  2. In case of error, LEZDOIT will inform the buyer within the terms, allowing them to validate the order accurately or cancel it. In no case will LEZDOIT be obliged to supply the product sold at the incorrectly indicated lower price.

  3. The prices on the site do not include VAT and do not include shipping costs. Prices may be subject to change at any time. Changes do not affect orders for which the Invoice Data Form has already been sent.

  4. Once the desired products or services are selected, it will be necessary first to accept the graphic preview, then follow the purchase instructions, entering and verifying the information requested at each stage of the order. The order details can be subject to modifications before payment.

  5. Payment can be made via: Bank Transfer; For card payment, availability must be requested.

Production

By “production” we mean the period it takes from the time the order is paid for until the product is handed over to the shipper. Shipping times are EXCLUDED from this timeframe.

Production of products will not begin until any outstanding payments, if present, are fully received.

Although the seller estimates the delivery will be on an approximate date, the buyer acknowledges and agrees that time is an estimate and not a guarantee.

Once an order enters the production phase, it can no longer be modified in any way.

Shipping and Delivery

By “delivery” we mean the time orders take from when they are handed over to the shipper to their arrival at the final customer. Production times are EXCLUDED from this.

  1. LEZDOIT ships to the entire Italian territory and abroad.

  2. LEZDOIT may deliver to the address indicated by the user or to the collection points indicated when confirming the shipping data.

  3. Delivery is made, for the Italian territory, normally within a period of 2 to 4 working days, or if no specific delivery date is indicated, within a maximum term of thirty days from the date of shipping confirmation.

  4. For EU countries, delivery will be made within 5 to 7 working days, in any case within the maximum term of thirty days.

  5. For non-EU territories, delivery will take approximately 10-15 working days. Any customs duties and charges will be borne by the purchaser.

  6. If delivery is not possible, the order will be sent to the collection point indicated. In such a case, a notice will specify where the order is and how to agree on a new delivery.

  7. If the delivery cannot take place for reasons attributable to the purchaser after thirty days from when the order is available for delivery, the contract will be considered resolved.

  8. In case of non-delivery due to unavailability of the recipient, the shipment will be returned to the sender.

  9. Any payment made will be refunded excluding shipping costs, which are charged to the customer.

Order and Invoice Request Form

After receiving the graphic preview, it is necessary to proceed with the completion of the Order and Invoice Request Form.

LEZDOIT reserves the right not to process orders that do not provide all the required data.

It is strictly forbidden to provide third-party information or fictitious data.

Before the issuance of the invoice, the customer must provide a copy of the bank transfer or payment confirmation if they proceed via alternative methods.

In the absence of proof of payment, it will not be possible to process the order.

Risk Transfer

The risks related to the products pass to the buyer from the time of delivery. Ownership of the products is considered acquired as soon as full payment is received for all amounts due concerning them, including shipping costs.

Cancelling an Order

An order can be cancelled in the following cases:

  1. If the status of your order is not yet at the “production” stage, you may cancel your order.

  2. You can request cancellation by emailing info@cmaxitaly.com with your name and order details. Our team will verify the status of your order and, if it is not yet advanced, we will be able to cancel it. In such a case, a 10% fee of the total order amount will be retained to cover administrative costs. If your order is already in a more advanced stage of graphic production, i.e., in the production phase, it will not be possible to cancel the order under any circumstances.

Please note: For personalised sportswear, the right of return cannot be applied under any circumstances.

Warranty and Commercial Compliance

  1. The seller is responsible for any manufacturing defects in the products offered, in accordance with Italian law.

  2. If the buyer has entered into the contract as a consumer, defined as any natural person who acts on the site for purposes unrelated to any entrepreneurial or professional activity, this warranty is valid provided that the defect appears within 30 days from the date of delivery of the products; that the buyer formally lodges a complaint regarding the defects within a maximum of 7 days from when the defect was recognised; and that the defect is reported via a request sent through the “contact” section of the site or by emailing info@cmaxitaly.com with clear photos showing the mentioned defect.

  3. In case of non-compliance, the buyer who entered into the contract as a consumer will be entitled to one of the following options:

    • Restoration of conformity, i.e., repair or replacement of the goods;
    • Reduction of the price, if repair or replacement is not possible or is deemed excessive;
    • Termination of the contract, if conformity cannot be restored within a reasonable time or if the defect cannot be eliminated.

Returns and Complaints

  1. For customised clothing, the right of return cannot be applied in any way.

  2. In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without penalty and without providing a reason within 14 days (pursuant to Article 57 of Legislative Decree 206/2005) from the date of receipt of the products. The right of return does not apply if the services and products from LEZDOIT under the CMAX brand include the supply of tailor-made or clearly personalised goods (Article 5, paragraph 3, letter c of Legislative Decree 185 of 22/05/99), or if they are products intended for COVID-19 health emergencies, or fall under the categories of Article 59 of Legislative Decree 206/2005.

  3. Users wishing to exercise the right of withdrawal can contact us through the “contact” section of the site or email info@cmaxitaly.com.

  4. The item must not have been used and must be returned in its original packaging, in good condition, suitable for resale. If these conditions are not met, it will not be possible to process the return or refund/exchange.

  5. Return shipping costs are the responsibility of the buyer.

  6. The refund (or exchange) will only occur after the seller receives the package and inspects it to verify the return conditions. You will receive an email once the refund has been issued, using the same payment method chosen by the buyer at the time of purchase.

Do not send the goods before receiving a response from the seller via email; failure to respond could significantly delay or even block the processing of your request.

It is recommended to ask the courier for a receipt of the package with tracking to provide the seller with proof of shipment. Similarly, doing so will allow you to track the transport of the item until it reaches the seller’s warehouse. If the return is made without tracking and the seller does not receive the goods, unfortunately, it will not be possible to obtain a refund.

Data Processing

  1. Buyer data is processed in accordance with the provisions on personal data protection, as specified in the dedicated section containing the information pursuant to Article 13 of EU Regulation 2016/679 (Privacy Policy).

Applicable Law and Jurisdiction

  1. These General Terms and Conditions of Sale are governed by Italian law and interpreted accordingly, subject to any other mandatory provisions in the buyer’s country of habitual residence. Therefore, the interpretation, execution, and resolution of the Sales Conditions are subject exclusively to Italian law.

  2. Any dispute relating to and/or arising from these terms will be resolved exclusively by the Italian judicial authority. In particular, if the buyer is a consumer, the dispute must be resolved by the court of the place of domicile or residence according to the applicable regulations
